How Texas estates usually reach a sale
Which path applies depends on the will, the trust and the court. An estate attorney will tell you which one fits.
Independent administration
The most common route with a will. Once the court issues letters testamentary, an independent executor can usually manage the estate and sell property without returning to court for each step, provided the will grants that power of sale.
Muniment of title
A simpler route for some estates with a valid will and no unpaid debts. It proves the will and transfers title without appointing an executor.
Affidavit of heirship
Sometimes used when there is no will, to document who the heirs are. Title companies have their own requirements, so involve an attorney early.
Trust property
If the home is held in a living trust, the trustee usually sells under the trust document without probate. The trust terms and the title company decide what is required.
